of Azerbaijan Republic " About the statement of the water code
",

The law consists
of 4 sections, 17 chapters and 105 articles. This law adjusts the
legal attitudes, connected to usage and protection of water objects
of the country. Water objects of the country and the part of the
Caspian sea is national riches of the Azerbaijan people. This riches
is used and are protected as a basis of life and activity of the
population, provide existence flora and fauna. In section of the
water code settlement of the attitudes, connected to use and protection
of water objects, underground and ground water objects, subjects
of the water attitudes and state municipal property on water objects,
is stated essence of the legislation,.
The second section of the code is devoted to the organization of
management by usage and guarding of water objects. In this section
are certain responsibility of the state both power of municipality
in the field of use and guards of water objects, state account of
waters, water code , state control of use and protection of water
objects.
The third section of the legislation (30-95 art) covers the instructions
for use and water protection objects. In this section (30-46 art)
rights of use of water objects, types of use of water objects, rule
of transfer of water objects for use, rights and responsibilities
of water-users, identification of damage, put in result to activity
of a water facilities are explained. Besides this code reflects
the following questions of use of water objects:
- Drinking, household, therapeutic-cultural, health-improving, sporting
purposes (47-50)
- Agricultural purposes (51-580)
- Water-power engineering and industry (59-63)
- Transport needs (64-65)
- Fishery and shooting (66-73)
- Special protected water objects (74-76)
In 14-th chapter of 3-nd section the general rules of protection
of water objects are reflected. In 81-93 articles the zones of protected
water resources, water-protected wood strips, sanitary security
zones are certain, allowable norms of harmful influence on water
objects are given. Here are marked about legal bases of extreme
situations on water objects and zones of ecological disasters.
In articles 94-95 of the code of legal conditions of an arrangement,
designing, construction, restoration and operation of the enterprises,
installations and other objects, have influence on water are expressed.
Last (4) the section of the law covers questions of economic regulation
of use and protection of water objects, decision of the conflicts
and the responsibility for infringement of the water code. In this
section principles of economic regulation of use and guards of water
objects (96), paid use of water (97), etc are described.
